Innovations of the Department of Migration for companies employing foreigners
Since April 1, 2018, after the new rules of procedure for issuing national visas have come into force, foreigners will be able to apply for a D visa on the basis of work only through diplomatic missions or consular institutions of the Republic of Lithuania.
Therefore, the changes are aimed at improving the flow control of foreigners who will work in Lithuania. And also to avoid situations when foreigners enter Lithuania through intermediaries, and not at the invitation of these employers.
The migration department created a “white list” of companies that accept foreigners for work. It is possible to get there if the company meets certain requirements, for example, the company should not have debts on basic social benefits in the state budget of the Republic of Lithuania, municipal budgets, customs, STI and Sodra, etc. Companies that want to get on this list must meet all the basic requirements and four additional ones.
The company enters the “white list” for three years, at the end of this period, it will be necessary to apply for re-entry.
If a company has debts to state or municipal budgets, unpaid fines, incorrect tax returns filled or other violations, the companies will be removed from the list.
The lists of approved companies and employers’ organizations are published on the website of the Department of Migration.
The undoubted advantage of the innovation is that foreigners who come to Lithuania to work for a company from the “white list” can apply for a working visa under a simplified procedure. They do not need to provide a work permit, a copy of the employment contract, documents confirming the availability of sufficient funds.
It should be pointed out that a foreigner is required to submit documents to the diplomatic mission or consular post of the Republic of Lithuania if:
- arrives in the Republic of Lithuania for work and has a work permit issued by the Lithuanian Labor Exchange for work in the Republic of Lithuania;
- arrives in the Republic of Lithuania for work and has a profession that is included in the list of missing professions approved by the Director of the Lithuanian Labor Exchange in accordance with economic activities;
- is sent to a Lithuanian company, that is, a permanent employee of a company established in a foreign country that is not a member of the European Union or the European Free Trade Association and who is temporarily sent to a Lithuanian company under a contract concluded between these companies for the provision of services or works as a specialist in his professional qualification;
- arrives in the Republic of Lithuania for seasonal work and has a permit issued by the Lithuanian Labor Exchange for seasonal work for more than 90 days;
- starts work in a company included in the approved companies list.
