Employing foreigners in Lithuania has become even less complicated

Lithuania has reached a stage of migration policy development where foreign talent attraction is an essential factor why its investment environment is improving. New legislative amendments which are introducing streamlined procedures with respect to Residence permits and the situation of employment of foreigners in Lithuania came into force.

The process of obtaining the residence permits becomes more swift

Submitting a written commitment declaring their place of residence will be the only evidence that foreigners will need to obtain.

The landlord’s official commitment to provide suitable accommodation is no longer required. This will make the process for obtaining a residence permit for foreigners faster and easier according to new regulations.

More flexible practices of employing foreigners in Lithuania

Managers with high professional skills, outside the EU, will be able to take up employment in Lithuania much faster than before, under the new regulations, by not having to get a decision of a Lithuanian Employment Service in order to fulfill the needs of the local labor market.

As other highly qualified employees are able to start working before receiving their residence permits, hiring procedures have become significantly more flexible for them. Under the amended regulations, highly qualified foreign applicants will be able to start working based on an eligibility decision from the Employment Service or in some cases if a decision of the Employment Service is not required, then the highly qualified applicant can start work from the date of submission for a temporary residence permit. This procedure also applies to relocating specialists who are planning to work in Lithuania under an intra-institutional transfer.

There are some exemptions according to law where it is not mandatory to obtain a work permit, which increases flexibility. A work permit will not be required when:

  • a foreigner’s profession is included in the list of professions that require high professional qualifications, and there is a lack of such specialists in Lithuania, or when the employer undertakes to pay the foreign employee a salary at least 3 times the size of an average Lithuanian salary;
  • a foreigner works remotely full-time under an employment contract with a company operating in Lithuania;
  • a foreigner arrives in Lithuania under an international youth exchange program.

Prospect of hiring international Master’s students

An opportunity to work full-time while studying in Lithuania is provided to Master’s students by the new amendments. Earlier, only doctoral students could work more than 20 hours a week. The talent pool is being broadened due to this change and is allowing investors to better utilize the potential of young and highly educated candidates.

The needs of today’s labor market are being reflected by a migration policy that Lithuania is developing. New legal changes which are enabling shorter immigration procedures for foreign specialists should provide an advantage to companies which operate in Lithuania when searching for talent from non-EU countries.
