Declaring the place of residence for foreigners in Lithuania will be easier

As of March 1, 2021, new amendments to the Law of the Republic of Lithuania “On the Legal Status of Foreigners” provide foreign nationals with flexibility in declaring their place of residence in Lithuania. Upon applying for a residence permit, foreigners now have the choice to declare their residence either at the Migration Department or later at the eldership after the permit has been revoked.

If the foreign national opts to declare their residence at the Migration Department during the residence permit application:

- The declaration of residence is integrated into the application process, eliminating the need for separate declarations.
- When applying for a temporary residence permit through MIGRIS, supporting documents confirming the right to reside in the specified premises can be attached. These documents may include consent from the owner or co-owner, rental agreements, letters from legal entities confirming residency, or dormitory accommodation documents.
- For permanent residence permit applications, one of the mentioned documents can be attached along with a commitment to declare residence in the appropriate premises.

However, if the foreigner prefers to declare their residence at the eldership after the permit’s revocation:

- The application can include a commitment to declare residence at the appropriate premises, with the actual declaration to be made at the eldership within one month after the permit’s revocation, following procedures established by the Director of the State Enterprise “Center of Registers.”

It’s important to note that each adult foreigner seeking a residence permit in Lithuania must ensure that their allocated living space meets certain criteria. Typically, this means a minimum of 7 square meters, though students or those pursuing education may have a reduced requirement of 4 square meters. Minors, international freight transport vehicle drivers, and certain temporarily employed foreigners are exempt from this requirement.

Failure to comply with the requirement to declare residence in Lithuania may lead to administrative penalties. Therefore, it’s crucial for foreign nationals to adhere to these regulations to avoid any legal ramifications.
